Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you and Local Technologies Inc. (“Local,” “we,” “us” or “our”) governing your use of the Local mobile applications, websites, technology, and platform (collectively, the “Local Platform”). The Local Platform connects passengers seeking taxi transportation services with licensed taxi drivers. By accessing or using the Local Platform, you agree to be bound by these Terms. If you do not agree, you may not use the Local Platform.

1. The Local Platform and Services

a. Local operates a technology platform that connects passengers with licensed taxi drivers for transportation services. Local is not a transportation provider and does not own vehicles or employ drivers.
b. Drivers provide Taxi Services independently using properly licensed and insured taxi vehicles equipped with government-regulated taxi meters. Taxi fares are set by local taxi authorities, not Local.
c. Local charges drivers a $1.00 dispatch fee per completed trip for access to the platform and dispatch services.

2. Eligibility

a. You must be at least 18 years old to create an account and use the Local Platform.
b. Drivers must meet additional requirements including holding a valid taxi driver’s license, maintaining proper insurance, and complying with all applicable laws and regulations. Drivers are responsible for ensuring their continued eligibility.

3. User Accounts

a. Passengers and drivers must create an account to access the full functionality of the Local Platform. You are responsible for maintaining the confidentiality and security of your account login credentials.
b. Drivers must provide accurate and up-to-date account information including taxi license details, vehicle information, and contact information.
c. Local reserves the right to suspend or terminate accounts for violation of these Terms, illegal activity, safety reasons, or other justifications outlined in our full terms.

4. Payment Processing

a. Passengers are responsible for paying drivers directly for the metered fare at the end of each trip. Drivers are responsible for collecting fares and resolving any fare disputes.
b. Local processes payments for platform fees charged to drivers, but does not collect passenger fares. Platform fees are charged using the payment method provided by the driver.

5. Ratings and Quality Control

a. Local uses a rating system to help maintain quality standards and promote accountability. Passengers and drivers may rate each other after completed trips.
b. Users must adhere to Local’s community standards and refrain from discriminatory, abusive, or retaliatory rating practices.
c. Local monitors user ratings and ride statistics. Low ratings, frequent cancellations, or other negative indicators may result in warnings, reduced platform access, or account termination.

6. Prohibited Activities and Misconduct

a. Users must comply with all relevant laws and regulations while using the Local Platform.
b. Illegal, unsafe, discriminatory, threatening, or abusive behavior is strictly prohibited, including physical violence, sexual harassment or misconduct, possession of weapons or illegal substances.
c. Drivers are prohibited from picking up street hails or otherwise circumventing the platform. Passengers may not request drivers to violate traffic rules or engage in illegal activity.
d. Misconduct may result in immediate account termination and cooperation with law enforcement as appropriate.

7. Safety and Ride Issues

a. Safety is a top priority for Local. However, Local cannot guarantee the safety or actions of platform users. Users are responsible for their own safety and bear all risk associated with use of taxi transportation.
b. Lost and found issues, disputes between passengers and drivers, and other ride-related problems should be reported through the Local app immediately. Local will make reasonable efforts to assist but cannot guarantee resolution.

8. Intellectual Property

a. All intellectual property rights in the Local Platform and related content are owned by Local and its licensors. Use of the Local Platform does not grant users any rights to this intellectual property.
b. Local’s trademarks, logos, and branding may not be used without express written permission. Drivers may only display Local branding as specifically authorized.

9. Data Collection and Privacy

a. Local collects personal information from users in accordance with our Privacy Policy, which is incorporated into these Terms. This includes location data, ride details, communication records, and other information.
b. Local uses collected data to provide and improve the platform, ensure compliance with these Terms, promote safety, and satisfy legal requirements. We take reasonable measures to safeguard user data.

10. Disclaimers and Limitation of Liability

a. The Local Platform is provided “as is” and without warranties. Local does not guarantee the availability, safety, or quality of taxi transportation arranged through the platform.
b. In no event shall Local be liable for any indirect, special, incidental, or consequential damages related to the use of the platform. Any direct damages are limited to the amount of Platform fees paid by the user in the 3 months prior to the event giving rise to liability.
c. Local shall not be liable for the actions or omissions of users, transportation services provided by drivers, or any illegal or tortious activity by platform participants. Each user agrees to release, indemnify and hold Local harmless for all such claims to the maximum extent permitted by law.

11. Dispute Resolution and Governing Law

a. These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Local provides the platform.
b. Any disputes, actions, claims or causes of action arising out of or in connection with these Terms or the Local Platform shall be resolved through binding arbitration on an individual basis, except for claims that may be brought in small claims court.
c. Arbitration shall be administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules. Judgment on the arbitrator’s award may be entered in any court with jurisdiction.
d. Any arbitration or legal proceedings shall be conducted only on an individual basis and not in a class, consolidated or representative action. Class arbitrations, class actions, and consolidation with other arbitrations are not permitted.

12. General Terms

a. These Terms constitute the entire agreement between you and Local regarding your use of the Local Platform, superseding all prior agreements.
b. Local may revise these Terms from time to time. Continued use of the platform after changes constitute acceptance of the revised agreement.
c. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
